These Terms and Conditions and any amendment thereon by Wasfat is considered a binding agreement between Wasfat App, and the user upon clicking the signup or downloading, accessing and utilizing Wasfat App services and shall be regarded as agreeing and acknowledging the terms and conditions have been read and understood.

3. ABOUT OUR APP

​

Our App provides you with an ability to share recipes with other users of our App, and browse other users’ recipes. Wasfat Service is made available free of charge.

Our Site is designed to work on simple and modern web browsers. Features and compatibility may vary between some web browsers, operating systems, and platforms.

We may use third-party service providers in the provision of the Wasfat Service or in fulfilling our obligations under these Terms of Service.

 

We do not promise that our App, any content on them, or services as may be provided by such third-party service providers, will be free from errors or omissions.

 

4. IMPORTANT INFORMATION REGARDING RECIPES

All recipes on our App are provided for general information only and published by other users, like you, and not by Wasfat. Wasfat App does not screen or check recipes before they upload, so there may be some inappropriate, incorrect or unsafe recipes, ingredients or cooking methods. The recipes, comments and other information provided on our App are not meant to amount to advice on which you should rely, and any use of or reliance on any recipe or other content provided on our App is at your own risk.

 

Wasfat makes no statements, whether express or implied, about the accuracy, quality, safety or fitness for recipes published on Wasfat.

 

Therefore:

 

• You should verify any unusual or novel ingredients or methods in a recipe by referring to other sources;

• you should comply at all times with any food safety notices or bulletins issued by your local government authority, and you should not expect Wasfat App to notify or explain risks contained in food preparation, method or techniques of cooking or consumption of specific food; and If you are not an experienced cook, we advise that you take instruction from an experienced cook (Like verified accounts), or other appropriate authority, when using recipes from the Wasfat, particularly in respect of health and safety.

5. INTELLECTUAL PROPERTY RIGHTS

​

The content on the Application and the trademarks, service marks and logos contained therein ("Marks") are owned by or licensed to Wasfat Company, and are subject to copyright and other intellectual property rights under the state of Kuwait and international conventions. Wasfat Content, includes, without limitation, all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics. All Wasfat graphics, logos, designs, page headers, button icons, scripts and service names are registered trademarks, common law trademarks or trade dress of Wasfat in Kuwait and/or other countries. Wasfat trademarks and trade dress may not be used, including as part of trademarks and/or as part of domain names, in connection with any product or service in any manner that is likely to cause confusion and may not be copied, imitated, or used, in whole or in part, without the prior written permission of Wasfat App. Wasfat App Content on the website is provided to you "AS IS" for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcasted, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. Systematic retrieval of data or other content from the website to create or compile, directly or indirectly, a collection, compilation, database or directory without written permission from Wasfat is prohibited.

 

• The logo and any other product, service name logo, slogan used by Wasfat and scripts are trademarks of Wasfat App. Therefore, it may not be used in whole or in part in connection with any product or service that is not Wasfat App Services.

• All other trademarks referenced in Wasfat App services are the property of their respective owners. Reference on Wasfat App Services to any products services processes or additional information by trade name trademarks and manufacturer supplier or otherwise does not constitute or imply endorsement sponsorship or recommendations thereof by Wasfat App or any other company affiliate or partner.

6. USER REGISTRATION

​

Concerning our App, you may not visit and view the recipes without registration. You will have access to more features of Wasfat if you create an account through certification. If you wish to register for an account to use the Wasfat, you will have to either complete the required account information as requested by us through applying such format as may be specified by us or sign up by third-party account (e.g., Facebook, Google).

 

We will conduct the necessary checks on your registration before or after the registration process and, once we accept, you will register as a registered user (“Registered User”).

 

We reserve the right to allow the user in creating, withdraw or discontinue your account, account details or password in the following circumstances. Where possible, we will give you notice of our intention to do this, and allow you to appeal:

• you do not exist;

• you do not have an email address that could receive emails;

• you breach these Terms of Service;

• you have or appear to have intentionally provided false information to us;

• you are a minor and have not submitted the account information with the approval of a parent or guardian;

• to respond to actual or potential threats to our business (such as cyber-security threats), or unwelcome or dangerous practices or behaviors in our community; or

 

If you have any comments or concerns about any recipes or other content on Wasfat App or, if you believe that your copyrighted work has been infringed or are aware of other infringing, illegal or inappropriate material, please contact us at support@wasfats.com

 

7. YOUR ACCOUNT AND PASSWORD

If you choose to become a Registered User, you must treat your account information as confidential. You must not disclose it to any third party. You accept full responsibility and liability for all activities that occur under your account, except where it is our fault.

• Your account password will enable you to open your page. You are solely responsible for maintaining the confidentiality of your account and password.

• You are required to restrict access to your computer and any activities that occur under your account or password will be your responsibility.

 

Please be sure that the information you provided to Wasfat App upon registration and at all times is indeed accurate and complete to the best of your knowledge.

You may not sell rent leases share or provide access to your account to anyone else including without limitation charging anyone for access to administrative rights on Your account, Wasfat App reserves all

 

legal rights and remedies to prevent unauthorized use of Wasfat App Services including but limited to technological barriers IP mappings. However, if you have any reason to believe that your account is no longer accurate for deferring threesomes please immediately notify Wasfat App.

 

If you know or suspect that anyone other than you knows your account, you must promptly notify us at support@wasfats.com.

8. CONTENT OWNER AND RIGHTS YOU LICENCE

​

We do not claim ownership of any recipes, photographs, video, graphics, comments, information, data, text or other materials you upload or post on our App ("Content").

However, when you upload Content, including a recipe, to our App, you grant us a worldwide, royalty-free, on-going and transferable right and license (which we may also allow to affiliates and a third party(ies), including other users) to use, copy, reproduce, process, adapt, modify, translate, publish, transmit, display and distribute (including via third parties). Moreover, content or derivatives of it, in any media or distribution method (now known or later developed) for any of our business activities.

 

You also agree that:

1. this license includes the right for us to provide promote and commercially exploit Content uploaded to our App in any means, manner or form to or with other users or persons who partner with us for the distribution or publication of Content on other media and services;

2. Such additional uses by us, other users of our App and other persons who partner with us for the distribution or publication of your Content may be done with no compensation paid to you concerning Contents that you upload to our App;

3. iii. You authorize us to report copyright infringement on your behalf to the designated agent, the site owner, hosting provider or any other appropriate contact when we find your Content is infringed; and

4. You waive or, where that is not possible, agree not to assert, all moral rights (and all similar rights in other jurisdictions) which you have or will have now or in the future in respect of your Content.

9. CODE OF CONDUCT

​

You promise that you will not:

 

1. infringe intellectual property rights of third parties, including without limitation, intellectual property rights such as copyright and trademark, of us, other users or third parties;

2. infringe the property rights, privacy rights and image rights of us, other users or third parties;

3. disclose information, such as the name, mailing address, telephone number and email address of a specific individual without authorization, and by which any third party can identify the said individual;

4. register multiple email addresses to obtain various accounts, while being a single user;

5. obtain an account on behalf of a Registered User whose mind has been suspended or terminated;

6. Discriminate against, harass, bully, intimidate, defame, or damage the reputation and credibility of, other users or third parties;

7. alter and/or erase Materials made available through the Wasfat;

8. impersonate us, other users or third parties (including doctoring email headers for the purpose of falsifying the source of email headers and the identity of the sender);

9. transmit computer programs or viruses that are harmful or cause other users or third parties to receive such programs or viruses;

10. accessing without authorization, or conducting port scans, denial of service attacks, or spamming the facilities of other users or third parties or the facilities used by Wasfat (including, without limitation, telecommunication facilities, computers and other equipment, as well as software that is used in the provision of the Wasfat by us) and/or causing or attempting to cause interference with the use or operation of such facilities;

11. transmit, without authorization, email that is advertisement or promotion or solicitation or that are of a repulsive nature (including spam); obstruct the receipt of email by other users or third parties; request the transmission of chain emails and/or transmission of chain emails in accordance with such requests;

12. circulate information, equipment, and software that are used for the purpose of disabling or circumventing the access control function of servers and other facilities;

13. reproduce, modify, disassemble, reverse engineer or analyze the samples or software contained in the Materials (except to the extent permitted by law, and you agree to give notice to us in such circumstance);

14. obtain account information without authorization or through fraud (including, without limitation, by phishing or similar methods);

15. use the Wasfat for commercial activities (including any incentivized activities), for-profit and in anticipation of profit, unless prior written approval has been obtained from us;

16. use the Wasfat for an election campaign or other political activities;

17. use the Wasfat in contravention of applicable laws and regulations;

18. hinder the operation of the Wasfat or hinder the exchange or sharing of Content contributed by other users or third parties, or cause damages or losses to us, other users or third parties by damaging their credibility or infringing their intellectual property rights;

19. cause significant hindrance to the operations of our business through repetitive, frivolous or vexatious inquiries or emails, which are beyond our obligations and/or are unreasonable;

20. breach the Terms of Service; or impede public order and morality (including, without limitation, by transmitting or displaying Content that may promote and induce violence, illegal images or suicide);

21. establish a link to our App in order to encourage any of the actions, including those by third parties, described hereinabove;

22. contravene such other requirements that we may impose from time to time at its sole and absolute discretion; or

23. Use Wasfat App in a manner that Wasfat reasonably deems unsuitable or inappropriate. Wasfat will refer to factors such as the typical use of Wasfat by the majority of its users, and general industry practice when determining whether such use is unsuitable or inappropriate.

10. RESPONSIBILITY FOR CONTENT

 

You are solely responsible for the Content that you post, upload, and/or publish using Wasfat App. We do not review or screen any of your Content before that Content appears or shared.

You promise that:

 

• any Content you post or publish and comply with these Terms of Service;

• you have the right to use, upload, post or distribute Contents to our App;

• the use by Wasfat of the Contents you uploaded, posted or published will not infringe the rights of any third parties.

You agree and acknowledge that:

 

• we will not be responsible, or liable to any third party, for the content or accuracy of any Content posted by you or any other user of our App;

• we have the right to remove any Content you make available on our App at our sole discretion, including; if in our opinion, your Content does not comply with these Terms of Service, or if we believe that it is necessary to protect ourselves, other users or any third party; and

• you are solely responsible for securing and backing up your Content.

 

11. CHANGES TO THESE TERMS

 

We may revise these Terms of Service (“Changes”) at any time if:

• there are changes in applicable laws and regulations;

• there are changes in the specification or operation of Wasfat App;

• there are changes to Wasfat group policy or internal controls;

• there are changes to the service specification or system of external third-party services used by Wasfat or connected to the Wasfat;

• there are changes to the business environment in which Wasfat operates;

• it is necessary to respond to actual or potential threats to our business (such as cybersecurity threats), or unwelcome or dangerous practices or behaviors in our community; it is necessary to clarify or make a correction of any part of these Terms of Service; or

• of other, unanticipated, situations that may reasonably require us to revise these Terms of Service;

 

Please check this page from time to time to take notice of any such changes that we make, as they are binding on you unless you terminate your account. We will notify you of material changes, including by posting when you visit our App or by email to the email address registered upon your account registration.

 

If you continue to use Wasfat after Changes made, you agree to the Changes. If you do not accept a Change: (i) if you are a Guest or Registered User, please stop using Wasfat.

12. RESTRICTION, SUSPENSION OR CANCELLATION OF USE

​

We may restrict, suspend, withdraw or discontinue your access to or right to use the Wasfat without prior notice in the following circumstances. Where possible, we will give you notice of our intention to do this, however:

• you have breached these Terms of Service;

• you have given us false information;

• you are using Wasfat illegally or in breach of any third party’s rights;

• it is necessary to protect ourselves, other users or any third party;

• it is likely that claims or proceedings may be brought against us by third parties due to circumstances that are connected to your use of Wasfat;

• it is not possible to establish contact with you through telephone, fax and/or email;

• it is an emergency; and/or

• it is necessary for operating Wasfat.

 

Restriction, suspension, withdrawal or discontinuation of the Wasfat could result in a permanent loss of access to and use of certain aspects of the services, including your uploaded Content, even if you later re-register or re-subscribe to the Wasfat.

13. LIMITATION OF OUR LIABILITY

​

Nothing in these Terms of Service excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation.

We will not be liable to you for any losses or damages suffered by you that: (i) were not reasonably foreseeable at the time you accepted these Terms of Service - loss or damage is reasonably foreseeable if either it was evident at the time you allowed these Terms of Service that it may happen, or both you and we knew it might happen, for example, if you and we discussed it; or (ii) are not caused by us breaching a term of these Terms of Service, or any other failure by us.

 

We will also not be liable to you for:

1. any errors or omissions in any recipe or other Materials;

2. use of or reliance on any Materials displayed on our App;

3. any unauthorized access to or use of our secure servers or any non-secured personal information;

4. any interruption or the cessation of transmission to or from our App;

5. a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programmers, data or other proprietary material due to your use of our App or to your downloading of any Materials on it, or on any website linked to it;

6. the content of sites linked on our App; and/or

7. third party demands, assertions, claims, suits, actions or other proceedings brought against you from other users, alleging that your Contents infringes any third party’s intellectual property rights, or misappropriates a third party’s confidential information.

14. INTERNET CONNECTIVITY

​

To use our App, your device will need a connection to the internet. You are solely responsible for obtaining, at your own expense, any hardware, software, and third-party services (such as a wireless service plan purchased through a telecommunications service provider) necessary to connect your device(s) to the internet. Moreover, including any data transfer fees that may be imposed by your chosen service provider and which, if you decide to upload large amounts of data such as image files, may be substantial.

15. THIRD-PARTY LINKS AND RESOURCES IN OUR APP

 

Where our App contains links to other sites and resources provided by third parties, these links Wasfat provided is for the public. We have no control over the contents of those sites or resources.

16. DESCRIPTION OF THE SERVICES

​

Wasfat App allows its members who ratify the agreement to social in our platforms.

 

Wasfat app provides a way for you to communicate with each other to get the best recipes and save ingredients in your cart.

The purpose of this app is to share good recipes with each other and to get the best out of every member of the community.

Wasfat does not sell or interfere in any way in the production or recipe of any food. However, what this social online offers to the users is only providing the ability to search and find ingredients in local

 

grocery stores. Ingredients are available to add to cart. Moreover, it is essential for users to understand that Wasfat does not in any way independently verify the ingredients or the quality of any products.

Users must make themselves comfortable through information provided by the grocery store on the application.

Wasfat does not in any way guaranty the quality of any food or that any food complies with applicable laws and does not guarantee to match the menu displayed on the site of what is provided to the users.

Wasfat shall not be liable or responsible for any food or services offered by the user that is unhealthy, is the cause of injury, that is otherwise unacceptable to users or that does not meet the expectation of user in any manner (you can check code of conduct section 9 for more information). Also, all food preparation is the sole responsibility of the user accepting the ingredients.

 

Once you selected a recipe from another user, a button “Ingredient” is visible. Once clicked, user will view a new page showcasing all ingredients and “add to cart” button. If the user clicked on add to cart, the ingredient will be view in cart automatically.

17. ENFORCEMENT

​

If any part of these Terms of Use is deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any of the remaining provisions of these Terms of Use. No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

18. UPDATING THESE TERMS

We may change our Service and policies, and we may need to make changes to these Terms so that they accurately reflect our Service and policies. Unless otherwise required by law, we will notify you before we make changes to these Terms and give you an opportunity to review them before they go into effect. Then, if you continue to use the Service, you will be bound by the updated Terms.

THE INFORMATION, CONTENT, PRODUCTS, SERVICES, AND MATERIALS AVAILABLE THROUGH THE APP (WHETHER PROVIDED BY WASFAT COMPANY, YOU, OTHER USERS OR OTHER AFFILIATES/THIRD PARTIES), INCLUDING WITHOUT LIMITATION, FOOD/BEVERAGE, SUBMISSIONS, TEXT, PHOTOS, GRAPHICS, AUDIO FILES, VIDEO, AND LINKS, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WASFAT DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINFRINGEMENT, FREEDOM FROM COMPUTER VIRUS, AND IMPLIED WARRANTIES ARISING FROM COURSE OF DEALING OR COURSE OF PERFORMANCE.
